Contract Compliance Division
The Contract Compliance Division effectively serves as a liaison, linking Small, Minority, Female and Disadvantaged Businesses with Clayton County related business opportunities and encourages equal opportunity for all businesses. It was created for the purpose of managing small local business and procurement non-discrimination per Clayton County’s Small Local Business Enterprise Program Ordinance No. 2017-45, § 1, 6-6-17.
Our contract compliance commitments include the following:
Listing of SLBEs and subcontractors – contractors must provide a list of all SLBEs and subcontractors to be used in the performance of the contract. Subcontractor participation in the contract will be monitored by the Contract Compliance Division (CCD).
Verification of subcontracts – Once the contract is awarded, CCD will verify the contracts with all listed SLBEs, and the dollar amounts that were approved by the board of commissioners.
Schedule changes – the contractor may not change the schedule of SLBE participation or engage substitute contractors without prior written consent from Clayton County. Requests for changes or substitutions must be made in writing, with a clear explanation of the basis for the request. Unauthorized changes may constitute breach of contract.
Additions – if a contractor wishes to hire a subcontractor for work that was not included in the original SLBE schedule that was submitted to the CCD, the request must be approved by the CCD, and the contractors must make a good faith effort to allow SLBEs a fair opportunity to bid on the new scope of work.
CCD decision is final – the final decision on a contractor request for changes or substitutions rests with the Director of Central Services Department and will be communicated to all parties in writing.
