E-filing

Clayton County Probate Court is currently accepting all electronically filed estate pleadings with the exception of a Petition for Year’s Support. Emergency adult/minor guardianship petitions are not currently permitted and will be rejected. All other adult/minor guardianship filings are permitted.

E-filing is only permissible for attorneys and is not currently available to unrepresented parties. TrueFiling users may both initiate new cases and well as file documents to existing cases. TrueFiling allows for easy, remote filing, with quick access to current/historic filings as well as case search functionality. Payment of filing fees is also managed through the application.  Register for TrueFiling.

When uploading documents in the portal please upload exhibits/supplemental information, death certificates, birth certificates, and Wills separately from pleadings whenever possible.

Additionally, any document that may contain sensitive information such as a SSN or bank account number should be uploaded separately to retain security of such sensitive information. Please do not redact information. The court clerk will do so upon receipt of the electronic filing.

Per the Uniform Probate Court Rules, there are a few notes of importance:

  • A copy of the Last Will and Testament must be uploaded in the portal. In addition, the original Will must be filed with the court within ten (10) days from the date of the electronic submission. Failure to file the original Will shall result in dismissal of the petition.
  • Surety bonds may also be uploaded in the portal, but the original document must be received and filed with the court in a timely manner.
  • All documents are still required to have original wet signatures and initials where required. Electronic signatures and /s/ are not acceptable and will be rejected.
  • The filer or filer’s attorney must retain all original documents that have been electronically filed in the event the originals are required in further court proceedings.
    • Do not mail the original documents to the court as this creates a duplicate filing. Only the Last Will and Testament and surety bond must be filed with the Court.
    • Stamp-filed copies may be obtained in the TrueFile portal and/or if public record they are also available online at www.georgiaprobaterecords.com.
