2007-01 - Providing for the designation of the Vice-Chairman for the Board of Commissioners; to provide for the term of office of the Vice-Chairman.

2007-02 - Prescribing the depositories of public funds for Clayton County.

2007-03 - Providing for the designation of person authorized to sign checks on the bank accounts of Clayton County; to authorize the Clerk to furnish the depositories of Clayton County public funds with a copy of this resolution together with the required specimen signatures.

2007-05 - Providing for the establishment of the legal holidays to be observed by the government of Clayton County during the period of July 1, 2007 - through June 20, 2008; to request that all elected officials of Clayton County observe such legal holidays; to provide for the observance of a personal holiday to be selected by each county employee.

2007-06 - Authorizing Clayton County to enter into a grantee-subgrantee agreement, Office for Domestic Preparedness State Homeland Security Grant Program FY06 with the Office of Homeland Security, Georgia Emergency Management Agency Division to accept grant funds on behalf of the Clayton County Police Department and to provide for the terms and conditions under which services will be rendered in connection with the Homeland Security Grant Programs.

2007-07 - To amend Resolution 2006-198 adopting a moratorium on the acceptance of applications for land use amendments, as well as applications for rezoning of parcels of land or buildings, as they relate to existing or proposed residential properties within all zoning districts within Clayton County to be in effect from January 1, 2007 - through and including July 31, 2007.

2007-08 - Rescinding Resolution 2005-103 which provided that the elimination or reorganization of county departments required the unanimous approval of the Board of Commissioners.

2007-09 - Authorizing creation of an advisory committee to review the Code of Clayton County, Georgia as amended, specifically Article II "Code of Ethics" Chapter 70, and other provisions relative to the conduct of officials and employees of the county.

2007-10 - Rescind Resolution 2005-93 authorizing Clayton County to enter into a local government agreement with the Georgia Department of Transportation and the Georgia Rail Passenger Authority providing for the establishment and operation of commuter rail passenger service for the Macon - Atlanta corridor.

2007-11 - Providing a statement of policy regarding the hiring and disciplining of Department Heads, and employees in the Office of the Board of Commissioners.

2007-12 - Authorizing Clayton County to enter into an agreement for the maintenance and use of Hospital Authority Facilities with the Clayton County Hospital Authority and Southern Regional Health System, Inc. providing for the terms and conditions under which payment of tax revenue will be paid and distributed to the Clayton County Hospital Authority and Southern Regional Health System, Inc.

2007-13 - Authorizing Clayton County to enter into a land lease agreement with William L. Abbate of Executive Aircraft Storage, LLC providing for the terms and conditions of land leases at Clayton County Airport-Tara Field which were formerly offered to National Aerotech Aviation, Inc and Northstar Aviation Specialist LLC.

2007-14 - To amend Code of Clayton County Georgia as amended, specifically Chapter 50 Health and Sanitation Article I in general, Section 50-2 "Board of Health Regulations" so as to amend the present enumerated definition of Board of Health Rules and Regulations accepted and approved for enforcement so as to amend subsection (1) so as to reflect the current Clayton County Board of Health, on-site sewage management systems rules and regulations.

2007-16 - Authorizing Clayton County to extend the SPLOST Program Management Agreement with CH2M Hill, Inc. providing for the establishment of compensation for year four (4) pursuant to the terms of the agreement.

2007-17 - Amending Section 2-34 of the Clayton County Code of Ordinances establishing a new time for the Board of Commissioners to meet for the Work Session scheduled for the first Thursday of the month and the Business Meeting scheduled for the third Tuesday of the month.

2007-18 - Authorizing Clayton County to enter into an Intergovernmental Agreement with the City of Riverdale providing for the terms and conditions under which municipal use of red light cameras will be administered.

2007-19 - Authorizing Clayton County to guarantee the Clayton County Development Authority's lease agreement with the City of Atlanta; to provide for the terms and conditions governing the use and occupancy of premises located at Hartsfield-Jackson International Campus and sublease agreement between the Clayton County Development Authority and tenants deemed appropriate for sublease.

2007-20 - Authorizing Clayton County to enter into a renewal agreement with Harris Ward & Webb Ellison Funeral Home, LLC, providing for the terms and conditions under which the transportation services of persons deceased to an appropriate facility will be rendered to Clayton County.

2007-22 - To adopt an extension of the moratorium on the acceptance of applications for land use amendments, as well as applications for rezoning of parcels of land or buildings, as they relate to existing or proposed properties within all zoning districts within Clayton County located on property fronting on Tara Boulevard (Highway 19/41) southward from its intersection with Upper Riverdale Road and continuing southward to the Henry County line with the exception of those areas included within the city limits of either Jonesboro or Lovejoy; to be in effect from enactment, through and including September 30, 2007, - or earlier; to adopt the purpose of the moratorium; to adopt the findings in consideration of the moratorium; to adopt the duration of the moratorium; to adopt an appeal process; to adopt an effective date of this resolution; to request that the governments of the cities of Jonesboro and Lovejoy enact similar moratoriums.

2007-23 - To adopt a moratorium on the acceptance of applications for land use amendments, as well as applications for rezoning of parcels of land or buildings, as they relate to existing or proposed properties within all zoning districts within Clayton County located on property fronting on Spur 138 eastward from its intersection with Highway 138, North Avenue, to its intersection with Highway 138, Stockbridge Road and Walt Stephens Road and on Highway 138 eastward from the city limits of the City of Jonesboro to the Henry County line to be in effect from enactment, through and including June 30, 2007 - or earlier; to adopt the purpose of the moratorium; to adopt the findings in consideration of the moratorium; to adopt the duration of the moratorium; to adopt an appeal process.

2007-24 - Authorizing the reorganization of the Clayton County Computer Center, Technical Support and Archives and Records to be combined as the Department of Information Technology.

2007-25 - To provide for the general oversight of employees in the Office of the Board of Commissioners, authorizing the Vice Chairman to sign documents in addition to the Chairman.

2007-26 - Authorizing Clayton County to enter into a right of way agreement with the Department of Transportation State of Georgia providing for the terms and conditions under which bridge replacement on 0.14 miles of Conkle Road at Reeves Creek will be facilitated, Project No. PR000-S009-00(517).

2007-27 - Providing for the abandonment and conveyance of Clayton County's interest in and to a certain section of the County road system, specifically Sherman Road, lying and being in Land Lot 46 of the 12th Land District of Clayton County, Georgia; providing for the naming of a certain portion of Sherman Road to Turnipseed Place in honor of Mr. William Turnipseed; to authorize the County to convey the subject right-of-way to the adjacent property owner(s) at the appraised fair market value.

2007-28 - Authorizing Clayton County to exercise its powers of eminent domain in accordance with provisions of GA laws for the purpose of acquiring certain properties for use by the Clayton County Transportation and Development Department for Joy Lake Dam repairs.

2007-29 - Authorizing Clayton County to renew the Commercial Crime and Public Official Bond Policy with Great American Insurance Company.

2007-30 - Authorizing Clayton County to renew the Administrative Services Agreement with Georgia Administrative Services.

2007-31 - Authorizing Clayton County to enter into an Intergovernmental agreement with the City of Morrow providing for the terms and conditions under which municipal use of red light cameras will be administered.

2007-32 - Authorizing Clayton County to enter into a Memorandum of Understanding with the Georgia Public Defender Standards Council providing for the delivery of Indigent Defense services under a hybrid delivery system as an alternative to the system set forth in the Georgia Indigent Defense Act.

2007-33 - To provide for a change in the names of certain public road right-of-ways; (portions of Sullivan Road to Forest Parkway, Ellenwood Road to Forest Parkway, Vanchant Street to Thomas Road, and Flint River Road to Thomas Road).

2007-110 - Determining and declaring reasonable and safe maximum speed limits on all highways, streets, and roads located in the unincorporated areas of Clayton County, Georgia.

2007-111 - Authorizing the execution, delivery and performance of the development agreement among Clayton County, Georgia, The Villages of Ellenwood, LLC and Peachtree Homes, Inc. in connection with the implementation of the Ellenwood Town Center Redevelopment Plan adopted in connection with the Clayton County Tax Allocation District Number 1 - Ellenwood Town Center.

2007-128 - Adopted under the Home Rule Powers granted to Clayton County pursuant to Article IX, Section II, Paragraph i of the Constitution of the State of Georgia of 1983, amending the Clayton County Code of Ordinances, specifically relevant sections of the Clayton County, Georgia Public Employee Retirement System to specify normal retirement benefit applicable to an identified class of participants.

2007-129 - Authorizing Clayton County to enter into an agreement with the Georgia Public Safety Training Center providing for the terms and conditions under which services will be rendered in connection with the Clayton Regional Law Enforcement Academy.

2007-130 - Authorizing Clayton County to enter into an amendment to the Clayton County replacement of zoning ordinances contract with the Collaborative Firm, LLC providing for the terms and conditions under which an overlay district for Highway 42 will be created for the County.

2007-131 - Authorizing Clayton County to enter into articles of agreement with certain community charitable organizations, governmental agencies, and professional service providers located and conducting business in Clayton County.

2007-132 - Authorizing Clayton County to enter into a community impact fund grantee agreement on behalf of the Clayton County Parks and Recreation Department's Aging Division, with the United Way of Metropolitan Atlanta and in accordance therewith accept grant funds to be used in association with the home delivered meals program.

2007-133 - Authorizing Clayton County to enter into an aging subgrant contract with the Atlanta Regional Commission on behalf of the Clayton County Parks and Recreation Department's Aging Division and in accordance therewith accept grant funds to provide services to older adults at risk in Clayton County, Georgia.

2007-134 - Authorizing Clayton County to enter into a license agreement with Alpha and Omega International (AOI), LLC providing for the terms and conditions under which the "Kingdom*Fest 2007" - gospel event will be conducted at the stadium and VIP suite of the Clayton County International Park.

2007-135 - Authorizing Clayton County to enter into an agreement with the Department of Transportation State of Georgia for the terms and conditions under which funding in the amount of $245,081.00 towards the Conkle Road Bridge Replacement Project, PR000-S009-00 (517) C1, will be provided to Clayton County by the Department of Transportation State of Georgia.

2007-136 - Granting approval to the Clayton County Water Authority, in accordance with GA. Laws 1955, P. 3344, et seq. for the acquisition of eminent domain, such property rights necessary for necessary improvements and replacement of existing water main.

2007-137 - To amend the Code of Clayton County, Georgia, as amended. Specifically Chapter 38. "Environment," Article VI, "Floodplain Management/Flood Damage Prevention", Division 8 Citation of Statutory Authority, Section 38-128 Citation of Statutory Authority, providing for insertion of the Citation of Statutory Authority.

2007-138 - To amend Resolution 2007-112 - adopting a moratorium on the acceptance of applications for land use amendments, as well as applications for rezoning or parcels of land or buildings, as they relate to existing or proposed residential properties within all zoning districts within Clayton County to be in effect from September 1, 2007, - through and including November 30, 2007.

2007-139 - Authorizing Clayton County to enter into a community impact fund grantee agreement, on behalf of the Clayton County Extension Service, with the United Way of Metropolitan Atlanta and in accordance therewith accept grant funds to be used in association with the ABC's of Parenting - Born to Learn Program.

2007-140 - Resolution authorizing Clayton County to enter into an agreement with the Department of Human Resources ("DHR") on behalf of the Clayton County Extension Service providing for the terms and conditions under which parent aide services will be provided.

2007-141 - Authorizing Clayton County to enter into a work authorization agreement with the LPA Group Incorporated providing for the terms and conditions under which professional services will be rendered as they relate to Clayton County Airport - Tara Field Construction of the Southwest Apron - Phase 2 Design.

2007-142 - Authorizing Clayton County to enter into an agreement with the Department of Transportation State of Georgia providing for the terms and conditions under which funding in the amount of $525,000.00 towards the cost of construction for the Southwest Apron Project at Clayton County Airport - Tara Field will be provided to Clayton County by the Department of Transportation State of Georgia.

2007-143 - Authorizing Clayton County to enter into a master lease agreement with Clayton County Governmental Finance Corporation, to be assigned to RBC Centura Bank, a North Carolina Banking Corporation, providing for the terms and conditions under which equipment will be leased to the County.

2007-144 - Authorizing the Clayton County Governmental Finance Corporation to enter into a equipment lease/purchase agreement, an absolute agreement and an escrow agreement (collectively the "Agreements") with Clayton County, Georgia, to be assigned to RBC Centura Bank, a North Carolina Banking Corporation, providing for the terms and conditions under which equipment will be leased to Clayton County.

2007-145 - Amending Resolution No. 2007-131 - which authorized Clayton County to enter into Articles of Agreements with certain community charitable organizations, governmental agencies, and professional service providers located and conducting business in Clayton County.

2007-146 - Authorizing Clayton County to apply for a grant from the Georgia Recreational Trails Program under which Clayton County will receive assistance in the amount of $100,000.00 for the maintenance of certain trails located within Clayton County.

2007-147 - Authorizing Clayton County to enter into agreements with the Georgia Department of Community Affairs, and in accordance therewith accept grant funds for various agency organizations and county projects.

2007-148 - Authorizing Clayton County to enter into a contract with Emerginet providing for the terms and conditions for individuals placed in custody or otherwise detained by law enforcement requiring emergency health care services.

2007-149 - Resolution authorizing Clayton County to enter into a reimbursable agreement with the Department of Transportation Federal Aviation Administration, providing for the terms and conditions under which temporary tower services will be rendered to Clayton County.

2007-150 - Resolution authorizing Clayton County to enter into a contract with the Georgia Department of Human Resources, an in accordance therewith accept grant funds on behalf of the Clayton County Cooperative Extension Service for promoting Safe and Stable Families program.

2007-157 - To amend the Code of Clayton County, Georgia, as amended, specifically, Code of Clayton County, Georgia, Part II, Chapter 18, Buildings and Building Regulations, Article VII, Housing Code, Section 18-433 [Amendments to the International Property Maintenance Code, 2003 Edition] and subsections thereof so as to amend said Section 18-433 by deleting Section 18-433 and subsections and adding a new Section 18-433 and subsections.

2007-158 - Authorizing Clayton County to accept a donation of certain vehicle parts on behalf of the Clayton County Police Department, to be used in connection with criminal activity.

2007-159 - Adopted under the Home Rule Powers granted to Clayton County pursuant to Article IX, Section II, Paragraph I of the Constitution of the State of Georgia of 1983, amending the Clayton County Code of Ordinances, specifically relevant sections of the Clayton County Civil Service Act and the Civil Service Rules and Regulations pertaining thereto, to provide for creation of an unclassified position.

2007-160 - Authorizing Clayton County to enter into a grant agreement with the Council of Juvenile Court Judges of Georgia in accordance therewith accept grant funds on behalf of the Clayton County Juvenile Court associated with the purchase of services program.

2007-161 - Authorizing Clayton County to enter into a grant agreement with the Governor's Office of Highway Safety and in accordance therewith accept grant funds on behalf of the Clayton County Police Department associated with the HEAT Program.

2007-162 - Affirmation resolution authorizing Clayton County to enter into a grant agreement with the Georgia Department of Human Resources and in accordance therewith accept grant funds on behalf of the Clayton County District Attorney's Office associated with the Child Support Recovery Program.

2007-163 - Authorizing Clayton County to enter into an agreement on behalf of the Clayton County Transportation and Development Department with CH2m Hill providing for miscellaneous engineering services.

2007-164 - By Clayton County supporting the continued use of prescribed fire in Georgia, as well as the Georgia Forestry Commission and Georgia Department of Natural Resources continued educational and technical assistance to landowners.

2007-167 - To amend Resolution 2007-138 - adopting a moratorium on the acceptance of applications for land use amendments, as well as applications for rezoning of parcels of land or buildings, as they relate to existing or proposed residential properties within all zoning districts within Clayton County to be in effect from November 30, 2007, - through and including February 3, 2008.

2007-168 - To adopt an extension of a moratorium on the acceptance of applications for land use amendments, as well as applications for rezoning of parcels of land or buildings, as they relate to existing or proposed properties within all zoning districts within Clayton County located on property fronting Tara Blvd (Hwy 19/41) southward from its intersection with Upper Riverdale Road and continuing southward to the Henry County line with the exception of those areas included within the city limits of either Jonesboro or Lovejoy.

2007-169 - To amend Resolution 2007-139 - adopting a moratorium on the acceptance of applications for land use amendments, as well as applications for rezoning of parcels of land or buildings, as they relate to existing or proposed properties within all zoning districts within Clayton County located on property fronting on Spur 138 eastward from its intersection with Highway 138, Stockbridge Road, and Walt Stephens Road and on Highway 138 eastward from the city limits of the City of Jonesboro to the Henry County line.

2007-172 - Stating that as of January 1, 2008, the county will no longer pick up or accept an animal from cities in Clayton County unless an intergovernmental agreement pursuant to OCGA§ 4-8-22(b) has been executed between the city and county.

2007-173 - Providing for the acceptance of certain property donated by Mike Baynard Inc. to be used in conjunction with the Clayton County Department of Transportation and Development's Garden Walk Boulevard Extension project.

2007-174 - Authorizing Clayton County to enter into a grant award agreement with the Criminal Justice Coordinating Council and in accordance therewith accept grant funds to be used in connection with the 2007 - Victims of Crime Act (VOCA) victim assistance grant program associated with the Solicitor's VWAP project.

2007-175 - Authorizing Clayton County to enter into a grant award agreement with the Criminal Justice Coordinating Council and in accordance therewith accept grant funds to be used in connection with the 2007 - Victims of Crime Act (VOCA) victim assistance grant program associated with the District Attorney's VWAP project.

2007-176 - Authorizing Clayton County to enter into a license agreement with Rainbow House, Inc. providing for the terms and conditions under which the "2007 - Festival of Lights" event will be conducted at the Clayton County International Park.

2007-177 - To authorize the Clayton County Community Development Department to issue a special permit to Charles & Vinzant Construction Company, LLC in connection with the Wal-Mart/Ellenwood project and in accordance with Clayton County Code of Ordinances, Section 62-3.3., Special Prohibitions, Subsection (9), Construction or Repair of Buildings, and Section 62-3.5, Special Permits, permitting construction activities during extended hours on Saturdays for a period of 90 days commencing November 10, 2007 - and terminating February 9, 2008.

2007-178 - Authorizing Clayton County to enter into a commercial viewing agreement with DirectTV on behalf of the Clayton County Prison providing for satellite television programming.

2007-179 - Providing for the abandonment and conveyance of Clayton County's interest in and to certain sections of county right of way. Specifically certain right of way related to the Rex Road SPLOST Project No. 306-4001-6000-BR001-7Y050.

2007-180 - To amend the Code of Clayton County, Georgia, as amended, specifically Chapter 98, Utilities, Article II, Water Authority Sewer Use, so as to amend Section 98-4, Industrial Waste Surcharge, Subsection (3), Flow Measurement; Section 98-6, General Sewer Use Requirements, Subsection (A)(3), Other Prohibitions, and Subsection (D), Local Limits; Section 98-7, Pretreatment of Wastewater, Subsection (F)(2)c., Requirements for Existing Food Service Facilities, Subsection (F)(4)c., Pump Out Order, Subsection (F)(4)e.2., Interceptor Sizing, Subsection (F)(5)b., Administrative Fees, Subsection (F)(5)d., Record Retention and Reporting, and Subsection (G)(3)b., Maintenance.

2007-181 - To amend the Code of Clayton County, Georgia, as amended, specifically Chapter 94, Traffic and Vehicles, Article III Parking, Stopping and Standing, so as to amend said chapter and article and to delete in its entirety the present Section 94-58 "Prohibited Parking of any Truck Tractor, Bus, Trailer or Semi Trailer, on Right of Way in Area Zoned Residential," and its Subsections, and to substitute in lieu thereof a new Section 94-58 "Multi-Wheeled Vehicles and Buses on Street Parking Prohibited within Residential Zoned District," and subsections.

2007-182 - To amend the Code of Clayton County, Georgia, as amended, specifically, Part II, Chapter 62, Offenses and Miscellaneous Provisions, so as to reorganize the existing sections within Chapter 62 into a new Article I "General," to add a new Article II "Quality of Life Code," to add a new Section 62-201 "Purpose and Definitions" and subsections, setting out the legislative findings and definitions used in the Quality of Life Code, to add a new Section 62-202 "Maintaining Property and Vacant Structures, Nuisance and Abatement thereof," and subsections, to add a new Section 62-203 "Abandoned or Vacant Buildings to Be Secured," and subsections, to add a new Section 62-204 "Parking or Storage of Commercial Vehicles, Buses, Trailers, Trucks or Equipment," and subsections, to add a new Section 62-205 "Off-Road Parking or Storage of Unlicensed or Inoperable Vehicles, Trailers or Equipment," to add a new Section 62-206 "Property of Dispossessed Tenant or Dispossessed Mortgagor to be Removed Within 48 Hours of the Date and Time of Execution of Writ of Possession."

2007-183 - Authorizing Clayton County to exercise its powers of eminent domain in accordance with provisions of Georgia laws for the purpose of acquiring certain properties for use by the Clayton County Transportation and Development department for the Forest Parkway Six Intersections project.

2007-184 - Authorizing Clayton County to accept a donation from the Links, Incorporated, Azalea City Chapter on behalf of the Clayton County Parks and Recreation, Kinship Resource Center, to be used in connection with the Grandparents Raising Grandchildren program.

2007-185 - To rescind that portion of Resolution 2007-25 - which provided for the general oversight of employees in the Office of the Board of Commissioners.

2007-187 - By the Clayton County Board of Commissioners authorizing an amendment to the airport leased with Tara Hangars LLC acknowledging the assignment of two lots to Pan Pacific Aviation LLC.

2007-188 - Resolution of the Board of Commissioners of Clayton County, Georgia authorizing the issuance and sale of tax allocation bonds (Ellenwood Project), Series 2007, - in the aggregate principal amount not to exceed $15,000,000 (The "Series 2007 - Bonds"), to pay, or to be applied or contributed toward, the payment of redevelopment costs associated with the projects identified on Schedules 1 and 2 hereto (The "2007 - Projects").

2007-189 - Authorizing Clayton County to enter into a grant award agreement with the Criminal Justice coordinating Council and in accordance therewith accept grant funds to be used in connection with the 2007 - Victims of Crime Act (VOCA) victim assistance grant program associated with Juvenile Court Child Abuse program.

2007-190 - Authorizing Clayton County to accept an allocation of funds associated with the quarterly compliance with the established Performance Partnership Agreement in the amount of $70,167.00

2007-191 - Authorizing Clayton County to exercise its powers of eminent domain in accordance with provisions of Georgia laws for the purpose of acquiring certain properties for use by the Clayton County Transportation and Development Department for the East Lovejoy Widening and Realignment project.

2007-192 - Authorizing Clayton County to enter into an agreement with Georgia Department of Natural Resources on behalf of the Clayton County Parks and Recreation Department providing for the terms and conditions under which the Kids Fishing Event will be conducted at the Clayton County International Park.

2007-193 - Authorizing Clayton County to convey an easement of county owned right of way to Georgia Transmission Corporation to be used in connection with the relocation of transmission line.

2007-194 - To amend the Code of Clayton County, Georgia, as amended, specifically Part II, Code of Clayton County, Georgia, Chapter 14, Animals, Article VII, Cruelty, so as to amend said article to add a new Subsection "8" to Section 14-166 Prohibited Treatment

2007-195 - Amending the by-laws of the C-TRAN Elderly and Disabled Access Advisory Committee (EDAAC) for such purposes as to assist Clayton County in serving the elderly and disabled transit rider.

2007-196 - Authorizing Clayton County to enter into an Amendment Number 3 to the Clayton County Replacement of Existing Zoning Ordinances contract with the Collaborative Firm, LLC providing for the terms and conditions under which the original contract for the time period of September 1, 2006-July 31, 2007 - be extended from August 1, 2007-May - 31, 2008.

2007-197 - Authorizing Clayton County to enter into an extension of consultant agreement for planning and program management services with W. Frank Newton, Inc. for the Clayton County, Georgia Community Development Block Grant Program, The Home Investment Partnership Act Program, the American Dream Downpayment Initiative Program, and the Emergency Shelter Grants Program providing for the terms and conditions under which the termination date will be extended from December 31, 2007 - to December 31, 2008.

2007-198 - To amend Resolution 2007-169 - adopting a moratorium on the acceptance of applications for land use amendments, as well as application for rezoning of parcels of land or buildings, as they relate to existing or proposed properties in all zoning districts within Clayton County located on property fronting on Spur 138 Eastward from its intersection with Highway 138, North Avenue, to its intersection with Highway 138, Stockbridge Road, and Walt Stephens Road and on Highway 138 Eastward from the city limits of the City of Jonesboro to the Henry County line to be in effect from enactment, through and including May 5, 2008, or earlier.
